Phil-i’m not the one paying it. My husband’s grandmother is going to pay it for us. We tried to put the loan in the bankruptcy, but they said it can’t be done since it’s a federal loan. They are telling me that in order for her to make the payment then they need a letter from my attorney giving me permission to pay outside the bankruptcy. The problem I have with that is one, the loan is not in the bankruptcy. Two, I’M not paying anything, she is. My attorney said that paying off that particular loan would be showing creditor preference. I filed for Chapter 7 Bankruptcy in Michigan. The only secured debt that I have is a car loan which I signed a reaffirmation agreement for. Now I have to go to court to prove that I will be able to afford my car payments. My question is how do I prove I can make my payment to the judge? My parents live with me and my mother was my co-signer for the loan. She plans on going and telling the judge that if I can’t make my payments she will do it. She doesn’t have a very large income though so I am not sure how much of an impact that will have. I really can afford the payments myself but the way they figure expenses for basic things like food and clothing differ from the way I budget. I spend much less than other people apparently. I have a little less than 10,000 credit card debt that I am trying to get rid of it. I haven’t used any of the cards in over a year. It is a total of four cards that rage from 20%-25% in APR. I have never missed a payment or have been late but it seems like I will never pay them off. I always pay more than the minimum payment also. Auto Loan Problem, Dealer Messed Up!?

Ok, so I went to the dealer the other day and picked out my car, I got them down to the price I wanted to pay, they said I was all good and they let me drive the car home. Here is the problem, I informed the dealer my credit was pretty bad and not to expect a good interest rate when they went for the loan, well, now the bank is saying there is no way they can get me the monthly payment I was expecting, the one I was told I would have to pay. So, I have a new car in my driveway, which I no longer want since they can not get me the monthly payment I was promised I would get. So, WHAT HAPPENS? Do I just return the car and sign some papers and its over or am I stuck with this dealership and have to look at a car in a different price range and settle with that? Personally, if they can not get me in this car for the price they said they could, I do not want to buy a car from them, I just want to return it and be done, this is aggravating, they should not have let me drive this car home and show it off if they could not get me in it for the price they promised, they just knew I was walking if they didn’t make my payments where I wanted. Please help!!!
